Terms & conditions of travel
General terms and conditions of travel of CASTAN Golfreisen Reiseveranstaltungsgesellschaft mbH (tour operator) for package holidays pursuant to §§ 651a et seq. BGB. These conditions supplement the statutory provisions and become part of the contract upon conclusion of the travel contract. The German version is legally binding.

1. Conclusion of the travel contract
1.1 With the registration (in writing, by email, via the enquiry form or by phone) the customer makes a binding offer to the tour operator to conclude the travel contract. The basis is the travel description, the individual offer and these terms.
1.2 The contract is concluded upon receipt of the tour operator’s booking confirmation. If the content of the confirmation differs from the registration, this constitutes a new offer to which the tour operator is bound for 10 days.
1.3 The person registering is responsible for the contractual obligations of all travellers registered by them, provided they have assumed a corresponding separate obligation.
1.4 Offers on this website are non-binding; prices are only stated in the individual offer and are subject to change until booking.
2. Payment
2.1 Upon conclusion of the contract and delivery of the insolvency protection certificate (§ 651r BGB), a deposit of 20 % of the travel price is due. The balance is due 30 days before departure, provided the trip can no longer be cancelled for the reasons stated in section 5.
2.2 For bookings made less than 30 days before departure, the entire travel price is due immediately.
2.3 If the customer fails to make payments despite them being due and despite a reminder with a deadline, the tour operator is entitled to withdraw from the contract and to claim cancellation costs pursuant to section 4.
3. Services, price changes
3.1 The scope of contractual services results from the booking confirmation. Information in third-party hotel and golf course descriptions is not binding on the tour operator.
3.2 Golf services (green fees, tee times, buggies) are confirmed subject to availability. Tee times may be moved by the golf club for maintenance or tournament reasons; the tour operator will endeavour to provide an equivalent replacement.
3.3 The tour operator reserves the right to increase the travel price after conclusion of the contract pursuant to § 651f BGB if transport costs, taxes, fees or exchange rates change; an increase is only permissible up to 20 days before departure and only up to 8 % of the travel price without a right of withdrawal for the customer.
4. Cancellation by the customer, rebooking, substitute person
4.1 The customer may withdraw at any time before departure. Receipt of the withdrawal declaration by the tour operator is decisive; written form is recommended.
4.2 If the customer withdraws, the tour operator may demand reasonable compensation. This amounts per person, as a percentage of the travel price, to:
- up to 45 days before departure: 20 %
- 44 to 30 days before departure: 35 %
- 29 to 15 days before departure: 55 %
- 14 to 7 days before departure: 75 %
- 6 to 1 day before departure: 85 %
- on the day of departure or no-show: 90 %
The customer remains free to prove that no damage or significantly lower damage was incurred. Different conditions of the airline may apply to flight services; these are shown in the offer.
4.3 Rebookings (travel date, hotel, room) are possible up to 30 days before departure for a fee of €50 per person plus any additional costs of the service providers; later rebookings are deemed a cancellation with new booking.
4.4 Up to 7 days before departure the customer may request that a third party enters into the contract (§ 651e BGB). The tour operator may object if the third party does not meet the travel requirements. Customer and third party are jointly liable for any additional costs.
4.5 We recommend taking out travel cancellation insurance.
5. Withdrawal and termination by the tour operator
5.1 The tour operator may withdraw up to 4 weeks before departure if the minimum number of participants stated in the description is not reached (§ 651h (4) no. 1 BGB); amounts paid will be refunded immediately.
5.2 The tour operator may terminate the contract without notice if the customer persistently disrupts the trip or behaves in breach of contract despite a warning.
6. Duty to cooperate, notification of defects
6.1 The customer is obliged to notify the tour operator or the local representative of defects immediately (§ 651o BGB) and to request remedy. If notification is culpably omitted, claims for reduction and damages may lapse.
6.2 Claims under § 651i (3) nos. 2 to 7 BGB must be asserted within two years of the contractually agreed end of the trip.
7. Liability
7.1 The tour operator’s contractual liability for damage that is not bodily injury and was not caused culpably is limited to three times the travel price (§ 651p BGB).
7.2 The tour operator is not liable for third-party services that are merely arranged (e.g. additional green fees, excursions on site), provided they are expressly marked as third-party services.
8. Passport, visa and health regulations
The tour operator informs about entry and health regulations for nationals of the state in which the trip is offered. The customer is responsible for compliance; disadvantages arising from non-compliance are at the customer’s expense.
9. Insolvency protection
In accordance with § 651r BGB the tour operator has ensured that the travel price paid will be refunded to the customer insofar as travel services are not provided as a result of insolvency. The protection certificate is handed over with the booking confirmation.
10. Data protection
Personal data is processed in accordance with our privacy policy.
11. Final provisions
11.1 German law applies. For actions by the customer against the tour operator, the operator’s registered office is decisive; for actions against customers who are merchants or legal entities under public law, Hamburg is agreed as the place of jurisdiction.
11.2 The invalidity of individual provisions does not affect the validity of the remainder.
